Although Puerto Rico has its own cannabis laws (Law 42-2017), it is subject to US federal law under the Supremacy Clause of the US Constitution. The Controlled Substances Act applies in Puerto Rico exactly as it applies in the 50 states. Cannabis cannot legally cross the Puerto Rico coast or airport border in either direction.

21 U.S.C. Β§812 β Schedule I classification applies throughout Puerto Rico. CBP enforces this at Luis MuΓ±oz MarΓn International Airport (SJU) and all seaports. All shipments entering or leaving Puerto Rico pass through US federal customs inspection.
Commonwealth Law (Local Program Only)
Law 42-2017 (Compassionate Use Act), as amended by Law 15-2023, established Puerto Rico's medical cannabis program. This law governs domestic cultivation, processing, dispensing, and patient access β but it has no authority over cross-border trade.
USβPuerto Rico Travel β Still Prohibited
Although travel between Puerto Rico and the US mainland is "domestic" and does not require a passport, it passes through TSA security (federal jurisdiction). Carrying cannabis between Puerto Rico and the mainland is a federal offence even though no international border is crossed.
Hemp & CBD β Same Federal Rules
Federal hemp regulations (2018 Farm Bill) apply in Puerto Rico. Hemp products with β€0.3% THC can move between Puerto Rico and the US mainland, subject to the same CBP, USDA, and FDA documentation requirements as any other US jurisdiction.

β‘ Critical Points to Watch β Puerto Rico
- Puerto Rico is NOT a separate country for US cannabis law. US federal law applies in full, including the CSA Schedule I prohibition.
- Medical cannabis patients cannot travel with their medicine to or from the US mainland without violating federal law β even with a valid Puerto Rico patient ID card.
- Local licenses mean nothing at the border. An ORC dispensary or cultivation license does not authorize any cross-border movement of cannabis.
- Seaports have CBP inspection. All container shipping arriving at or departing Puerto Rico ports passes federal customs β this is not a loophole.
- Hemp businesses must follow identical rules to other US jurisdictions β Puerto Rico's Commonwealth status does not create any simplified pathway.
