Overview & Legal Status

Oklahoma has one of the most expansive medical cannabis markets in the US — over 2,000 licensed dispensaries and a physician-friendly certification process. State Question 820 (March 2023) to legalise adult-use failed with ~61% opposition. Governing law: 63 O.S. § 420 et seq.

Medical Patient Possession

  • Registered medical patients may possess: 3 oz flower (person), 8 oz flower (residence), 1 oz concentrate, 72 oz edibles, 6 mature + 6 seedling plants
  • Must carry Oklahoma Medical Marijuana Patient Licence at all times
  • Home cultivation of 6 mature and 6 seedling plants permitted for patients

Adult-Use Possession

  • Without a medical licence, any marijuana possession is illegal in Oklahoma
  • Possession of up to 1.5 oz: misdemeanour — fine and/or up to 1 year
  • Repeat offence: felony — 2–10 years

Transaction Rules

  • Medical: 18+ with Oklahoma Medical Marijuana Patient Licence + government ID
  • Non-Oklahomans may obtain a 30-day temporary licence if their state recognises medical cannabis
  • Residents: annual licence $104.50

Local Ordinances

  • No Oklahoma municipalities have enacted decriminalisation
  • Local ordinances exist for dispensary zoning distance requirements (schools, churches, etc.)
  • Several municipalities voted to allow or restrict dispensary operations in their jurisdiction

⚠️ Adult-Use Cannabis — Important Warnings

  • Adult-use cannabis is NOT legal in Oklahoma. Possession, sale, and cultivation outside the medical programme remains a criminal offence.
  • Medical cannabis patients must carry their state-issued registry card at all times when possessing cannabis.
  • Cannabis cannot be transported across state lines — this is a federal offence regardless of destination state laws.
  • Do not drive or operate machinery while impaired by cannabis — DUID laws are strictly enforced.
  • Airports operate under federal jurisdiction — carrying cannabis through airports is prohibited.
  • Cannabis is prohibited on all federal lands (national parks, forests, federal buildings).
  • Keep all cannabis and CBD products out of reach of children and pets.
  • Cannabis use during pregnancy or breastfeeding is strongly discouraged by health authorities.
