Overview & Legal Status
Idaho is one of the strictest states in the US regarding cannabis — there is no medical cannabis programme, no decriminalisation, and no adult-use legalisation. All forms of marijuana remain fully illegal under Idaho law. Notably, Idaho does not accept the federal hemp definition and has its own THC-zero policy. Idaho Code § 37-2701 et seq. governs controlled substances.
Key Facts
Adult-Use StatusFully illegal — no ballot initiative process available in Idaho
Medical ProgrammeNone — Idaho has rejected multiple medical cannabis efforts
Hemp/CBD StatusRestricted — Idaho requires 0.0% THC (not the federal 0.3% standard); effectively prohibits most hemp-derived CBD
Governing LawIdaho Code § 37-2701 et seq. — Uniform Controlled Substances Act
RegulatorIdaho State Police; Idaho Dept. of Agriculture (hemp)
Legislative OutlookNo active legislation for medical or adult-use as of 2026
Licensing
Licence Types in Idaho
- No Medical Cannabis Licences — Idaho issues no medical marijuana cultivation, processing, dispensary, or delivery licences of any kind
- No Adult-Use Cannabis Licences — recreational cannabis market does not exist
- Industrial Hemp Permit (Restricted) — Idaho Code § 22-5101 et seq.
- Idaho's hemp law requires 0.0% THC — stricter than the federal 0.3% THC standard under the 2018 Farm Bill
- This effectively prohibits most commercially viable hemp cultivation and nearly all hemp-derived CBD products
- Idaho Dept. of Agriculture issues permits for research hemp only — not commercial cultivation
- CBD products derived from hemp grown in other states may be illegal to possess in Idaho if they exceed 0.0% THC
- Research exceptions: Universities may conduct limited cannabis research under controlled schedules
Critical Note: Idaho does not recognise the federal 2018 Farm Bill hemp definition. Bringing hemp-derived CBD products with >0.0% THC across state lines into Idaho from a neighbouring state may constitute drug trafficking under Idaho law.

Implications
- Idaho has no cannabis tax framework of any kind — all cannabis is illegal and untaxed
- The 6% state sales tax applies to hemp products that meet Idaho's 0.0% THC standard — an extremely small market
- Idaho loses significant tax revenue compared to neighbouring Oregon and Washington
- Idaho businesses cannot participate in the cannabis industry without violating state law
Advertising
Advertising of Cannabis Products
- All cannabis advertising is effectively illegal in Idaho — no legal product exists to advertise
- Advertising marijuana products to Idaho consumers would constitute promotion of an illegal substance under Idaho law
- CBD advertising: Consumer protection rules apply; advertising CBD products with >0.0% THC would promote illegal products in Idaho
- Out-of-state cannabis businesses must be careful not to target Idaho consumers in digital, social media, or mail campaigns
- Idaho Attorney General may pursue consumer protection actions against companies advertising illegal cannabis products to Idaho residents
Workplace Rules
Employee Rights & Employer Obligations
- No employment protections for cannabis users of any kind — Idaho law does not recognise cannabis use as protected activity
- Employers freely enforce drug-free workplace policies; positive cannabis tests are valid grounds for termination, discipline, or non-hire decisions
- Idaho Drug-Free Workplace Act: Employers may implement comprehensive drug testing programmes
- Pre-employment, random, post-accident, reasonable suspicion testing all lawful
- No notice requirements beyond written policy publication
- Cannabis use — including in states where it is legal — does not create employment protection when employee returns to work in Idaho
- Federal contractors: Strictly subject to Drug-Free Workplace Act — cannabis prohibited
- Safety-sensitive industries (transportation, construction, mining) — zero-tolerance strongly enforced
- No pending legislation to add any employment protections for cannabis users

- Purchase of cannabis in a neighbouring state (Oregon, Washington, Nevada) and returning to Idaho constitutes drug trafficking
- Hemp with 0.0% THC may be sold but the market is extremely limited
Product Testing
Testing Framework
- No cannabis product testing framework exists — no legal cannabis products are produced or sold
- Hemp testing: Idaho Department of Agriculture tests hemp for THC compliance — must confirm 0.0% THC
- Law enforcement may submit suspected marijuana samples to Idaho State Police Forensic Services for testing
- No state-licensed cannabis testing laboratories exist
Medical Cannabis
Idaho has NO medical cannabis programme. Multiple attempts to establish medical cannabis in Idaho have failed — most recently, a 2020 ballot initiative effort was not certified due to signature challenges. The Idaho Legislature has consistently rejected medical cannabis bills.
Legislative History
- Idaho is one of only a handful of US states with no medical cannabis programme of any kind
- Idaho voters approved Proposition 1 (1998) for medical cannabis — overridden by the legislature
- Multiple subsequent ballot initiatives and legislative proposals have been defeated
- No qualifying conditions, patient registry, or physician certification programme exists
- Patients seeking medical cannabis must travel to Oregon, Washington, or Nevada and cannot legally return to Idaho with the product
- Idaho's constitutional initiative process has been made more difficult through legislative changes
Medical Cannabis PossessionNot applicable — no programme in Idaho
Adult-Use Cannabis
Adult-use cannabis is fully illegal in Idaho. Idaho has no ballot initiative mechanism for constitutional amendments — the Legislature would need to act, which is considered politically very unlikely given the conservative political landscape.
Legal Status & Comparison
- No adult-use cannabis market exists — all possession is criminal
- Idaho borders Oregon (full adult-use legal since 2015) and Washington (legal since 2012) but enforces its own strict laws
- Idaho State Police conducts border operations targeting cannabis smuggling from neighbouring states
- No tax revenue framework — Idaho receives no cannabis tax revenue
Local Ordinances
- No Idaho municipality has enacted cannabis decriminalisation — state law prohibits it
- Local law enforcement cooperates with state police on cannabis enforcement
- Cities near the Oregon/Washington border have highest cannabis arrest rates due to cross-border activity
Criminal Penalties
Possession
- 3 oz or less: Misdemeanour — up to 1 year, $1,000 fine
- Over 3 oz: Felony — up to 5 years, $10,000 fine
- Within 1,000 ft of school: Mandatory doubling of sentence
Sale & Trafficking
- Trafficking — any amount: Felony — 1–5 years, up to $15,000 fine
- Large-scale trafficking (1 lb+): Felony — 3–15 years mandatory minimum
- Sale to minor or near school: Enhanced mandatory sentences; up to life imprisonment for large quantities
⚠️ Adult-Use Cannabis — Important Warnings
- Adult-use recreational cannabis is NOT legal in Idaho. Possession, sale, and cultivation outside any approved medical programme remains a criminal offence.
- Medical cannabis patients (where a programme exists) must carry their state-issued registry card at all times when in possession of cannabis.
- Cannabis cannot be transported across state lines — this is a federal offence regardless of destination state laws.
- Do not drive or operate heavy machinery while impaired by cannabis — DUID/DUI laws are enforced.
- Airports operate under federal jurisdiction — carrying cannabis through airports is a federal offence.
- Cannabis is prohibited on all federal lands including national parks, forests, and federal buildings.
- Keep all cannabis and CBD products out of reach of children and pets at all times.
- Cannabis use during pregnancy or breastfeeding is strongly discouraged by health authorities.
